During the relative period, Dellas, acting as a CTA’s CTA or the CTA’s connected man and the DSD Capital, acting as CTA, has committed fraud through embezzlement and through material misleads and omissions.

To maintain their continued fraud, the defendants took steps to hide and flood their behavior. Among other things, Dellas concealed the substance of the documents that direct his clients
to sign. Dellas also spoke to a customer, ordering a brokerage company to lift the restrictions he had put in capital transfers to DSD Capital and another business to stop sending customer account statements, despite the customer repeatedly asked Dellas’ statements.
The defendants are accused of violations of sections 4b (a) (1) (a) and (c) and 4th (1) (a)-(b) of the law on the exchange of basic products (“act”), 7 usc §§ 6b (a) (1) (a), (c). 6th (1) (a)-(b).
