
The Securities and Exchange Commission (SEC) has filed a lawsuit against 5 Fruits Enterprises LLC, Calvin Guess and Marcus Ligon.
The SEC complaint, observed by the FX News Group, was submitted to the Nevada District Court on September 4, 2025.
Calvin Guess is the founder and management member of the 5 Fruits Enterprises LLC. Has never been linked to any entity registered with the committee.
Marcus Ligon held the title of co-operator of 5 Fruits Enterprises LLC and served as Guess’s administrative assistant. Has never been linked to any entity registered with the committee.
5 Fruits Enterprises LLC is a limited liability company formed in Nevada in October 2021. 5 Fruits were an investment entity that raised funds to participate in automatic options. It is no longer functional. Has never been registered with the Commission in any property.
The SEC complaint claims that, from 2021 to 2023, in communications with investors, guessing and Ligon offered the use of their automated “bots” in transactions, promised incredible returns and guaranteed that investments would be used for options.
None of them were true.
Instead, the defendants had no bots or any other automated negotiation technology, failed to create either promised returns or give back the original investment and spending the vast majority of investor money money money and Ponzi.
Through the false and misleading demands and their plan to deceive investors, the defendants increased about $ 4.7 million from investors across the country.
The Securities and Exchange Commission accuses the accused of violations of sections 5 (a), 5 (c) and 17 (a) of the Mobile Values Act, 15 USC § 77E (A), 77E (C) and 77Q (A) and Article 10 (b) of the Act of Exchange, 15 USC § 78j (B) and Rule 10.
As a result, the Securities and Exchange Commission seeks an order against the defendants to permanently impose them from the future violations of these provisions, to permanently violate them to participate in certain behaviors and to require them to pay discoloration and interest in prejudice.
