The Australian Securities and Exchange Commission (ASIC) has permanently banned Brett Paul Trevillian from providing financial services and carrying out credit activities after being convicted of serious fraud.

The condemnation related to Mr Trevillian creation and distribution of fake performance verification reports used to provide for investment by Alphathorn Pty Ltd.

Mr. Trevillian was the only director and secretary of the Metal Alpha Pty Ltd and acted as an investment director for Alphathorn Pty Ltd.

According to the 2001 (CTH) and the National Consumer Consumer Consumer Protection Act (CTH), ASIC may permanently prohibit a person from providing financial and credit services if convicted of serious fraud, which includes impunity offenses.

Mr. Trevillian has also been permanently banned by:

  • Checking an entity carried out by a financial services business
  • Running any operation involved in the transfer of a financial services company and
  • Participation, control or execution of any operation involved in credit activities.

The ban has entered into force on August 18, 2025.

Mr Trevillian’s ban has been recorded in the forbidden and excluded register.

On December 20, 2024, Mr Trevillian was sentenced to two charges of making a false document to obtain a financial advantage in accordance with the S253 of the 1900 Crimes Act (NSW) and was sentenced to three years in prison to serve a strong correction.
