The patent infringement lawsuit brought by OANDA against GAIN Capital is not over.

Earlier this week, the brokers filed a joint letter with the District Court of New Jersey, providing an update on the latest developments in this lawsuit.

The parties recently met and agreed on GAIN’s letter to the OANDA regarding the sufficiency of the OANDA violation allegations. As a result, OANDA agreed to further amend its claims of infringement in certain respects and GAIN would then serve its scheduled responsive amended claims of non-infringement.

Recall that in this lawsuit, OANDA claims that GAIN infringes two patents, US patent no.

On March 5, 2013, the United States Patent and Trademark Office issued United States Patent No. 8,392,311, entitled “Currency Trading System, Methods, and Software”.

The ‘311 patent teaches, among other things:
